North Carolina Supreme Court decision 640PA05 filed August 18, 2006 (Armstrong etal. v. Ledges Homeowners Association etal.) obligates us as follows:
“Payment of the utility bill is the single shared obligation contained in petitioners’ deeds, and each lot owner’s pro rata share of this expense totals approximately seven dollars and twenty cents per year.”
Beginning in 2007, we have submitted an annual payment to Duke Energy in compliance with the Court’s ruling, and we respectfully ask that you apply the enclosed check to account number #9100 0174 6587*. The annual payment has been adjusted for estimated inflation.
